Santa is standing by his field, looking absolutely furious.
A large pile of rocks and loose soil from the road construction above has slid down and covered a significant portion of his potato patch.
Banta finds him muttering angrily to himself.
“I will not spare him!”
“I will go to the police!” Santa fumes.
“That Thekedar, Mr. Verma!”
“He has destroyed my crop!”
“He has thrown his garbage onto my land!”
“When I confronted him, he just laughed and said, Uncle ji, it’s just a little soil from the mountain, what’s the big deal?”
“Think of it as a free gift!'”
Banta looks at the damage, his face grim.
“A free gift, he says?”
“Santa, this is not a gift; it is a debt.”
“And it is time we had a system to make him pay it.”
“Pay it?”
“He just shooed me away!” Santa says, dejected.
“In a place with a proper, strong Debris Disposal Policy,” Banta explains, his voice firm, “the story would be very different.”
“That policy would clearly state that the Janmdaata of the debris – in this case, Mr. Verma’s Company – is 100% responsible for its safe disposal.”
“It’s not the mountain‘s soil anymore; it’s his construction waste.”
He continues, “Under such a policy, Mr. Verma couldn’t just laugh.”
“An officer would come and impose a heavy penalty on him for his negligence.”
“And more importantly, the policy would have a provision for compensating you, the affected community member.”
“The Thekedar would be legally bound to pay for your lost crop and the cost of clearing your land.”
“There would be a system of accountability.”
Santa’s eyes widen. “A system where he would have to pay me for my potatoes?”
“And a fine on top of that?”
“That sounds like a dream, Banta!”
“It shouldn’t be a dream, Santa; it should be the law,” Banta insists.”
“Without accountability, there is no fear, and without fear of penalty, there is no incentive to be responsible.”
“We need a policy that makes it cheaper for the Thekedar to dispose of the debris safely in a designated spot, than to carelessly dump it and then pay the fine and compensation.”
“Only when his pocket is affected will his practices change.”
Santa, now empowered with an idea, straightens his shoulders.
“You are right, Banta.”
“We shouldn’t just be asking for our land to be cleared.”
“We should be demanding a system of accountability so this doesn’t happen to anyone else.”
“Mr. Verma’s free gift has a debt attached, and it’s time we sent him the bill!”
